JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-10-2015 Petitioners are two wives of Swatantrata Sainik Samman pensioner Late Bhular Mishra, who passed away on 26.5.1995. They got benefits of the scheme belatedly only after the order of this Court dated 12.1.2005, passed in C.W.J.C.No. 14358 of 2003. They submit that they are entitled to payment of interest on delayed payment of pension.

Counsel for the State filed counter affidavit. He submits that in compliance of order dated 12.1.2005, the concerned respondents immediately took action and a huge amount was paid to the petitioners on 29.4.2005. Further, MJC NO.4368/2009 filed for non compliance of that order has also

Counsel for the petitioners submits that only after filing of MJC, part payment of arrears have been made. The writ petition is disposed of with liberty to the petitioners to raise the issue before the respondents, who would furnish them the chart of payments within three months thereof. In case any payment is found still to be due, then in that case petitioners would be entitled to interest.
