The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 506, 325, 379, 307/ 34 of the Indian Penal Code.
The learned counsel for the petitioners submits that the petitioner nos.1 and 2 are persons with clean antecedent and the petitioner no.3 has antecedent of one case and the informant alleges that the accused persons including the petitioners came to his house variously armed and thereafter, Pravin Kumar
Patna High Court CR. MISC. No.65650 of 2021(3) dt.14-07-2022 2/3 assaulted the informant on his head, but he managed to save himself and got injury on his left hand and his ankle also fractured. Thereafter, it is alleged that Chattish Kumar assaulted Mantun Kumar by iron rod on his head causing injury. Thereafter, Ravish Kumar assaulted Gunjesh Kumar by khanti on his head causing injury. Thereafter, it is alleged that the accused persons also snatched gold chain worth Rs.52,000/- and the injured were taken to hospital for treatment. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. It is next submitted that there is a case and counter-case. It is also submitted that injury suffered from the side of the petitioners are also grievous in nature. It is thus submitted that since both sides had a fight in each the injured got injury, as such, the petitioners should be enlarged the privilege of the anticipatory bail. The learned counsel next submits that some of the injuries are simple in nature also.
At this stage, the leaned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application.
Permission is accorded.
Accordingly, instant petition is dismissed as
Patna High Court CR. MISC. No.65650 of 2021(3) dt.14-07-2022 3/3 withdrawn.
However, in the event, if the petitioners surrender before the learned Court below by 28.07.2022, then the learned Court below shall dispose of the case on the same day, if possible.
