In this application for anticipatory bail the petitioner apprehends his arrest in connection with Dehri (T) P.S. Case No. 548 of 2016 for the offences punishable under sections 147, 148, 337 and 353 of the I.P.C, sections 4 (1-A) and 21 (1) of the D.E. Act, section 40 (1) of the Bihar Mining Act and section 33, 41 and 42 of the Forest Act.
Allegedly, the police raided Gopi Bigha Crusher Market and found illegal Crusher Machines running and preparing stone chips. The police seized the articles used for preparing stone chips and the owners of the Crusher Machines fled away. Name of
Patna High Court Cr.Misc. No.43966 of 2017 (2) dt.19-09-2017 2/2 this petitioner is also mentioned as one of the owner. Submission is of false implication and that there is general and vague allegation, there is no specific allegation against the petitioner, similarly situated co-accused Sunil Sharma has been allowed pre-arrest bail vide Cr. Misc. No. 26654 of 2017 by order dated 06.07.2017 by another co-ordinate Bench of this Court and as such the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that co-accused Sunil Sharma has been allowed pre-arrest bail. In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M, Dehri, Rohtas in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
