The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 14 of 2018, registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code.

The accusation is that in the morning of 23.01.2018, four persons named in the F.I.R. including the petitioner came near the informant, Md. Mahboob Alam, and started to cause assault to the informant. At that time, this petitioner gave knife blow at the stomach of the informant.

Learned counsel for the petitioner submits that occurrence took place due to land dispute, in fact, injury, as

Further submissions is that there was land dispute in between the petitioner and the informant and the dispute has been settled, accordingly, mother of the petitioner has executed the sale deed on 15.02.2018 in favour of informant Md. Mahboob Alam and similarly, Md. Jainuddin, father of the informant, also executed the sale deed in favour of the petitioner on same day, i.e., 15.02.2018.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Purnea, in connection with Dagarua P.S. Case No. 14 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
