JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Singheshwar P. S. Case No. 97 of 2015 registered under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.
It is contended that there is case and counter case in which members of both sides sustained injuries. It is further
Patna High Court Cr.Misc. No.1821 of 2016 (3) dt.11-04-2016 2/2 contended that the entire occurrence took place due to land dispute existing from before and the petitioners have got no criminal antecedent. It is also contended that in the alleged incident, the petitioners had also sustained injuries on their person.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in Singheshwar P. S. Case No. 97 of 2015, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
