2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 10 litres country made mahua liquor has been recovered from the spot.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case merely on suspicion. Nothing has been recovered from conscious possession of this petitioner. Petitioner claims clean antecedents and he is in custody since 26.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.59315 of 2024(2) dt.06-09-2024 2/2 of the case, nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge of Excise-01, Aurangabad, in connection with Barun P.S.
