The petitioners apprehend their arrest in a case registered under Sections 20 and 22 of the NDPS Act. As per first information report, the informant arrested three other accused persons and from their possessions, A.T.Van tables were recovered, whereas the petitioners are alleged to have fled away seeing the raiding party but on the confessional statements of the other co-accused, their names figured in the case. It has been submitted on behalf of the petitioners that the petitioners were not arrested on the spot. Further, from perusal of the fist information report, it appears that A.T.Van tablets are said to have been recovered from the possessions of other accused persons. Further, it has been submitted that the co-accused has been granted bail vide Cr.Misc.No.12033 of 2015. On behalf of the State, it has been submitted that the petitioners are named in the first information report. Considering the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.24373 of 2015 (2) dt.14-07-2015 2/2 petitioners, named above, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Khagaria in connection with Special Case No.7-A of 2014 arising out of Khagaria Rail P.S.Case No.20 of 2014, subject to condition as laid down under section 438(2) of the Cr.P.C.
