JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 354, 379, 504 and 506 of the Indian Penal Code and Section 3(1) (x) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act.

Prosecution case is that for making protest as the goat of the accused persons grazed the crop of the informant, the accused persons abused the informant by calling caste name, made assault and took out Rs. 500/- from the pocket of the informant's husband. The accused persons also caused injury to the informant's husband with knife.

It is submitted by learned counsel for the petitioner that there is no injury report of the husband of the informant on

Patna High Court Cr.Misc. No.4683 of 2016 (2) dt.04-02-2016 2/2 record. Statement to the aforesaid effect has been made in para 9 of the petition which reads as follows:- "That there is no injury report on record to support the allegation alleged against the petitioner." A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail of the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Khanpur P.S. Case No. 60 of 2015 pending in the court of learned SDJM, Samastipur. Accordingly this application is disposed of.
