2. The petitioner apprehends his arrest in a case registered for the offence under Section 56(2) of Bihar Minerals Act 2021 & Section 21 of M.M.D.R. Act and Section 379 of the Indian Penal Code.

3. As per the prosecution case, this petitioner is alleged to have unauthorisedly mined soil from the field of informant of estimated value of Rs. 3,52,096/-.

4. It is submitted on behalf of petitioner that present case has been lodged with ulterior motive and due to pending land dispute between the parties. Petitioner has committed no such offence and there is no chit of paper in support of the allegation. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bagaha, District West Champaran in connection with Bagaha P.S. Case No. 169 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
