The petitioner apprehends his arrest in connection with Special Case No. 666 of 2017, arising out of Palasi P.S. Case No. 148 of 2019, registered under Section 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, pending in the court of the Addl. District and Sessions Judge-II, Araria. The accusation is of recovery of 360 bottles, each containing 300 ML Nepali Soufi from the house of petitioner. Learned counsel appearing on behalf of the petitioner submits that at the time of recovery of alleged liquor, the petitioner was not present at his house.

Having considered the facts and circumstances of

Patna High Court CR. MISC. No.51084 of 2019(2) dt.17-08-2019 2/2 the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
