JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Hussainganj P.S. Case No. 289 of 2014 for the offences instituted under Sections 341, 324, 307 of the I.P.C. and 27 of the Arms Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that co-accused Pankaj Kumar came and called the grand-son of the informant Arvind Kumar and took away. After some time, the informant got information that Sanjay and Pankaj have fired on his grand-son. The informant came at the place of occurrence and found blood. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It is

Patna High Court Cr.Misc. No.27860 of 2015 (2) dt.22-07-2015 2/2 further submitted that the petitioner has got no criminal antecedent.

On behalf of the State it has been submitted that there is specific allegation of causing injury upon the victim against the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in Hussainganj P.S. Case No. 289/2014, pending in the court of the learned C.J.M., Siwan. Anyhow, if the petitioner surrenders in the court below within a period of four weeks from the date of receipt/production of the copy of this order the learned court below shall consider the case of the petitioner without being prejudiced by this order.
