JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Baisi Case No. 273 of 2021, Pre-trial No.434 of 2021, instituted for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 29.09.2021, charge-sheet has been submitted and is a person with clean antecedent and allegation is of recovery of 61.87 litres of liquor tied with seat of the motorcycle and petitioner is alleged to be a person driving the motorcycle, further from a scooty of Prashant, 8.250 litres of liquor is alleged to have been recovered.

Patna High Court CR. MISC. No.65881 of 2021(2) dt.11-02-2022 2/2 The learned counsel submits that the petitioner has falsely been implicated in this case merely he was going on the motorcycle when the police stopped him and roped him with the false allegation.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact the petitioner is in custody since 29.09.2021, is a person with clean antecedent and charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Purnea, in connection with Baisi Case No. 273 of 2021, Pre-trial No.434 of 2021.

The application stands allowed.
