JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 365/ 511 of the Indian Penal Code.
It is alleged that the petitioner along with co accused Raju Kewat and Kundan Kumar made attempt to abduct the son of the informant namely Piyush Ranjan by forcefully making attempt to get him sit on a motorcycle.
It is submitted by the learned counsel for the petitioner that the petitioner is neighbour of the informant and for petty dispute the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that for the occurrence of
Patna High Court Cr.Misc. No.4655 of 2016 (2) dt.04-02-2016 2/2 19.6.2015 the FIR was registered on 22.6.2015. Considering the delayed nature of accusation and Statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Jehanabad P.S. Case No.257 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
