The petitioner seeks bail in Udwantnagar (Gajrajganj OP) P.S. Case No. 202 of 2020 corresponding to NDPS Case No. 12 of 2020, registered for the offence punishable under Sections 8/20(b)(ii)(c) of the NDPS Act.

As per the prosecution case, 377.890 KG of Ganja has been recovered from the house of Pyari Devi and petitioner is alleged to have fled away from the place of recovery. It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from the house of co-accused. Mandatory provision of search and seizure has not been followed. Petitioner claims clean antecedent and he is in custody

Learned APP however, vehemently opposed the prayer for bail and submitted that more than commercial quantity of Ganja has been recovered and petitioner was seen fleeing away from the place of recovery.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
