JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioners and the State. The petitioners being mother and brother of the husband of the complainant are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and section 4 of Dowry Prohibition Act. It is submitted by the learned counsel for the petitioners that the accusation of torture has been levelled after about 13 years of the marriage. Thrust of accusation is against the husband of the complainant who is ready to keep the complainant with dignity and honour. Statement to that effect has been made in paragraph
Patna High Court Cr.Misc. No.3538 of 2016 (2) dt.22-01-2016 2/2 11 of the petition which reads as follows:
"That the complainant's husband is ready to keep the complainant as wife with full dignity."
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishunganj (Madhepura) in connection with Complaint Case No. 56 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
