JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506 and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Accusation is of making assault and abusing by calling caste name.
It is submitted by learned counsel for the petitioner that no injury was caused to the informant and for a petty dispute the accusation has been levelled. The F.I.R. was registered on 11.05.2015 but it reached to the court of learned I/c Judicial Magistrate on 13.05.2015 which suggests antedating of F.I.R. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.31571 of 2015 (2) dt.06-08-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada SC/ST P.S. Case No.35 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
