JUSTICE SANJAY PRIYA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 376, 406, 307/34 of the Indian Penal Code. It is alleged that after the death of the husband of the informant, petitioner brought her to Aurangabad in his house and established physical relation on promise to marry her. She gave birth to a child. He kept the informant two years properly and thereafter he refused to marry her and send to one Rana Pratap Singh saying that she is married with him . It is further alleged that both made physical relation with her on assurance of marriage for eight years. Thereafter both ousted her saying that both are already married persons.
It has been submitted on behalf of the petitioner that he
Patna High Court Cr.Misc. No.31259 of 2017 (2) dt.10-07-2017 2/2 has filed an informatory petition on 03.04.2017, vide Annexure 2, prior to lodging of present FIR, stating that the informant is a married lady to Rana Pratap Singh, after the death of her husband. The petitioner is in custody since 27.04.2017. Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. . Let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Aurangabad in Aurangabad Mahila P.S.Case no. 15 of 2017, subject to the conditions that both bailors will be the close relatives of the petitioner.
