JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 420 and 120B of the Indian Penal Code.
Prosecution case is that co-accused Govardhan Singh executed a sale deed in favour of Mahanth Sri Sinehi Sharan Das, Sri Radha Krishan Thakurbari on 23.06.1952. Since then the Mahanth of the said Thakurbari was in possession of the land, in question. Subsequently, the complainant came to know that the said land, in question, has been transferred by way of committing forgery by the accused persons. The matter was enquired and the complainant came to know that through registered sale deed the land, in question, was transferred by Laxman Singh in the name of the petitioner and co-accused persons.
Patna High Court Cr.Misc. No.4643 of 2016 (2) dt.04-02-2016 2/2 It is submitted by learned counsel for the petitioner that the petitioner is a bona fide purchaser of the land, in question. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the fact that the thrust of accusation is against Laxman Singh, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Barh, Patna in connection with Salimpur P.S. Case No.38/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
