The petitioner filed this restoration petition for restoration of Cr. Misc. 3518/2017 which was dismissed for nonprosecution on 23.05.2017. Learned counsel for the petitioner submits that the petitioner had gone to Bangalore to attend his ailing mother after entrusting the case to Mr. Ajay Kumar who did not appear on 23.05.2017 and subsequently, Cr. Misc. 3518/17 was dismissed for non-prosecution, but I find that Cr. Misc. 3518/17 was filed on 27.01.2017. The case diary was called for vide order dated 16.02.2017, thereafter, the petitioner took adjournments on 08.03.2017, 18.03.2017, 27.03.2017, 04.04.2017, 19.04.2017, 27.04.2017 and 12.05.2017. The petitioner took adjournments on many dates without informing the court about his non-availability.

Patna High Court Cr.Misc. No.31256 of 2017 (2) dt.19-07-2017 2/2 Order-sheet itself shows that the petitioner took adjournment after adjournments.

Considering the facts aforesaid, I do not find any merit in this case. Accordingly, the same is dismissed with liberty that the petitioner may file fresh anticipatory bail petition. (Prabhat Kumar Jha, J.) Vinita/- U T
