1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 74, 77, 78, 109, 303(2), 117(2), 329(4), 75 and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioners submits that petitioner nos. 1 to 4 are persons with clean antecedent and petitioner no. 5 has antecedent of three cases, but is on bail. It is

No.54380 of 2025(2) dt.21-08-2025 2/3 next submitted that the informant alleges that she was standing near Anchal office, when Pankaj Yadav came and started talking obscene things and even acted inappropriately, but when her parents came, Pankaj fled thereafter her parents informed the police and gave a written complaint, upon receiving the information that a complaint has been given to the police, the accused persons including the petitioners came and assaulted her uncle and took Rs. 23,500/- along with some silver ornaments.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that petitioners have no concern with Pankaj. It is next submitted that even allegation of assault is general and omnibus in nature though the injured is opined to have received grievous injury. It is next submitted that from the side of the petitioners also, Goradih P.S. Case No. 83 of 2025 has been instituted against the side of the informant and others. It is next submitted that petitioner will not abscond rather will co-operate in the investigation to prove their innocence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Goradih P.S. Case No. 82 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioners despite giving assurance to this Court are not co-operating in the investigation, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioners.
