The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 387, 353, 506, 504 of the Indian Penal Code.

The prosecution case is that the petitioner entered into the chambers of the informant, who is a Block Development Officer, and abused him.

It is submitted by the learned counsel for the petitioner that there is no accusation or demanding of extortion and no offence under Section 387 is made out and there is nothing on record to suggest that the petitioner applied criminal force for considering the offence under Section 353 of the Indian Penal Code. The petitioner filed a complaint against the Block Development Officer on 30.11.2015 and thereafter

Patna High Court Cr.Misc. No.4396 of 2016 (2) dt.01-02-2016 the present case has been lodged on 02.12.2015. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the complaint filed by the petitioner at earlier point of time, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S.
