Learned counsel for the petitioner submits that earlier the bail application of the petitioner was rejected vide order dated 15.12.2021 in Cr. Misc. No. 19649 of 2021, Learned counsel for the petitioner submits that out of nine charge-sheet witnesses, five-six witnesses have already been examined. It is next submitted that from side of the prosecution, an application has been filed for examining four more prosecution witnesses, it is nothing but a ploy to delay the trial as the prosecution is aware of the innocence of the petitioner.

After hearing the learned counsel for the petitioner, the Court is not inclined to grant bail to the petitioner.

No.55291 of 2022(2) dt.19-10-2022 2/2 However, in the event, if the trial is not concluded within a period of six months from the date of receipt/production of a copy of this order, then in that event the petitioner would be at liberty to renew his prayer for bail before the learned trial court and if the learned trial court comes to a conclusion that the trial was not delayed at the instance of the petitioner, then will consider his bail application in accordance with law.

Accordingly, the bail application is dismissed. (Satyavrat Verma, J) Rishi/- U T
