Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409, 418, 419, 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act.
It is alleged against the petitioner that being appointed as In-charge of the paddy purchase centre, he purchased 7356.80 quintals of paddy out of which only 7157.86 quintals of paddy were supplied to millers and remaining 198.94 quintals of paddy worth Rs. 2,59,497.34 were misappropriated.
It is submitted by learned counsel for the petitioner that petitioner is ready to deposit the aforesaid amount within a period of three months by depositing the
Patna High Court Cr.Misc. No.36178 of 2015 (2) dt.08-09-2015 2/2 same through bank draft in favour of The Bihar State Food & Civil Supplies Corporation, Patna.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for four months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 167 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail will be confirmed by learned Court below on submission of draft of Rs. 2,59,497.34 in favour of The Bihar State Food & Civil Supplies Corporation, Patna within a period of three months.
