JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is seeking regular bail in Forbesganj (Simraha) P.S. Case No. 57 of 2017 (G.R. No. 342 of 2017) registered under Sections 25(1-b) A/26 of the Arms Act. Learned counsel for the petitioner submits that the First Information Report has been lodged by the Sub Inspector of Police, who is said to have gone in search of the petitioner in connection with Narpatganj P.S. Case No. 23/2017 registered under Sections 302, 120(B)/34 IPC read with Section 27 of the Arms Act.

It is alleged that the petitioner when apprehended informed the police about the concealed arms and at his instance

Learned A.P.P. for the State opposed the prayer for bail and submitted that the petitioner has got criminal antecedent and out of three cases registered against him, he has been granted bail only in two cases, the third case being Narpatganj P.S. Case No. 23/2017, registered under Sections 302, 120(B)/34 IPC, is still pending for investigation.

Since the present case seems to have been connected with the case under Section 302 IPC, this Court is not inclined to grant regular bail to the petitioner in the above mentioned case at this stage.

However, the petitioner can renew his prayer for bail if he gets the privilege of bail in Narpatganj P.S. Case No. 23/2017. The application stands rejected at this stage. (Rajeev Ranjan Prasad, J) Dilip, AR U T
