ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 08.04.2019 in connection with Khajauli P.S. Case No. 217/2018 registered for the offence punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire cases which have been lodged against him are false and fabricated and in all such cases he has been remanded after his arrest in connection with Kaluahi P.S. Case No. 4 of 2019 on 15.01.2019. Learned counsel for the petitioner submits that thereafter he has been remanded in connection with the present case. It is further submitted that earlier the petitioner had been granted anticipatory bail in connection with Kaluahi P.S. Case

Patna High Court CR. MISC. No.54950 of 2019(2) dt.05-09-2019 2/2 No. 91 of 2018, thereafter he got married in a temple, but after he was taken into custody, he has been remanded in two other cases of subsequent date. Learned counsel for the petitioner submits that the entire allegations are false and mischievous and nothing has been recovered from his possession and it only on account of the personal grudge with Chulahi Paswan that the entire allegations have been levelled against him. Considering the aforementioned facts and circumstances and that there being no recovery from the possession of the petitioner, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, III, Madhubani, in connection with Khajauli P.S. Case No. 217/2018.
