Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 332, 333, 353, 337, 338, 153A, 435, 436, 307, 295A, 342 of the Indian Penal Code and 3 of the Prevention of Damage to Public Property Act.
The prosecution case is that on the eve of Chhat festival someone broke the kalash, when 500 people obstructed the N.H.-57. In the meantime the mob lit fire to the Government vehicles parked in Simri Police Station. It is alleged that petitioner being husband of the Panchayat Mukhiya and other persons were leading the mob. It is submitted by the learned counsel for the petitioner that the police lodged the present case in order to
Patna High Court Cr.Misc. No.3920 of 2016 (2) dt.27-01-2016 save his own skin as no action was taken by the police on the First Information Report lodged by the accused persons. The accusation is against the mob.
Considering the accusation against mob, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Simri P.S. Case No. 153 of 2015, pending in the court of learned J.M., Ist Class, Darbhanga.
With the above observation this application is disposed of.
