The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 386, 353 and 414/34 of the Indian Penal Code.

It is alleged against several persons named in the F.I.R. to have collected money on behalf of one Rit Lal Yadav on the eve of Assembly Election. It is submitted by learned counsel for the petitioner that in the F.I.R. it is not mentioned that any public made complaint with regard to any collection and due to political rivalry the case has been lodged. Petitioner was not named in the F.I.R. and investigation is still pending. It is further submitted that the petitioner is a government

Patna High Court Cr.Misc. No.33892 of 2014 (2) dt.27-03-2015 2 / 2 servant and co-accused have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 3910 of 2011 and 4260 of 2011. Statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Danapur P.S. Case No. 309 of 2010 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
