The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case is that six unknown miscreants robbed ornaments and cash of the informant while the informant was travelling in a car. The name of the petitioner sprang up on the confession of co-accused Rakesh Kumar. During investigation, it also transpired that the petitioner talked to the other accused person on the alleged date of occurrence. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.4529 of 2016 (2) dt.03-02-2016 2/2 petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Gurua P.S. Case No.35/2014, pending before the learned CJM, Gaya. With the above observation, this application is, accordingly, disposed off.
