This is the fifth attempt of the petitioner to approach before this Court for bail. Earlier the prayer for bail application of the petitioner was rejected with a direction to the learned Court below to expedite the trial.

Vide order dated 23.11.2022, a report was called for from the learned Court below regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 14.12.2022 has been sent by the learned Additional District & Sessions Judge-I-cum-Special Judge,SC/ST Act, Lakhisarai, which is at Flag 'A' to this petition. In his report, the learned Judge has, inter alia, stated that out of 12 prosecution witnesses, 11 prosecution witnesses

Patna High Court CR. MISC. No.59085 of 2022(4) dt.04-01-2023 2/2 have already been examined by the prosecution. At present this case is fixed on 21.12.2022 for prosecution evidence i.e. examination of the last witness of this case. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby once again rejected.

The learned court below is directed to conclude the trial within six months.
