JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-07-2017 The petitioner seeks bail in connection with Darauli P.S.Case No. 20 of 2013 registered under Sections 392 and 411 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 14.12.2015 passed in Cr.Misc. No. 55872 of 2015.
It would be evident from the record that the petitioner has been made accused in more than a dozen cases of similar nature.
It has been submitted by the learned counsel for the petitioner that till date only two witnesses have been examined during trial.
Considering the nature of offence, antecedents of the
Patna High Court Cr.Misc. No.26019 of 2017 (2) dt.05-07-2017 2/2 petitioner and the stage of the trial, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. Since the petitioner is in custody, the learned Chief Judicial Magistrate, Siwan is directed to hold the trial expeditiously and conclude the same within eight months from the date of receipt/production of a copy of the order, failing which the petitioner would be entitled to renew his prayer for bail.
