The petitioner seeks anticipatory bail in connection with Sikta P.S. Case No. 168 of 2017, registered for offences punishable under Section 20, 22, 23, 24 and 27(a)/29 N.D.P.S. Act.
Petitioner is not named in the FIR and the allegation is that SSB has arrested a person, who disclosed his name Sunil Kumar and this person disclosed the name of the petitioner and after search, four kg ganja apprehended from his possession and accordingly, seizure list was prepared.
Submission of the learned counsel for the petitioner is
Patna High Court Cr.Misc. No.40353 of 2018 (2) dt.11-07-2018 2/2 that except confession of arrested person, there is absolutely nothing against the petitioner.
Learned A.P.P. opposes the prayer for bail.
n In view of the allegation against the petitioner, above named, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court. With the aforesaid observation, this application is dismissed.
