The petitioner seeks bail in a case registered for the offence punishable under Section 364 later on added u/s 302, 120(B), 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the FIR is against unknown. Occurrence is alleged to have taken place on 16.11.2018. FIR has been lodged on 20.11.2018 after four days delay. Name of this petitioner has come in confessional statement of co-accused Akhilesh Bharti.
Learned counsel for the petitioner further submits that the petitioner is in custody since 22.01.2019 and has got no criminal antecedent. Charge has been framed against the petitioner. The similar situated co-accused has been granted bail by the Co-
Patna High Court CR. MISC. No.53045 of 2019(4) dt.18-11-2019 2/2 ordinate Bench of this Hon'ble Court vide order dated 10.05.2019 in Cr. Misc. No. 31362 of 2019.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3rd, Gaya, in connection with S.Tr. No. 565 of 2019/210 of 2019 (arising out of Suhail P.S. Case No. 21 of 2018).
