2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 191(2), 191(3), 190, 118(1), 109, 308(3), 351 of the B.N.S. and Section 27 of the Arms Act.

The allegation in the first information is that as many as 15 persons came variously armed and resorted to indiscriminate firing on account of which the informant and one Manoj Kumar received bullet injury and there is allegation on some other accused persons of assaulting by means of the butt of the rifle and lathi.

Learned counsel for the petitioners submits that it would be apparent from the first information report itself that the name of these three petitioners has been taken in a general manner along with other accused persons with regard to resorting to indiscriminate firing. The specific allegation of receiving of gun shot injuries is from the gun which was being carried by co-accused Vikash, Prabhunath and Chandrakant Singh and there is further allegation of assaulting by means of butt of rifle and lathi upon Akash, Rajesh Singh and Chandrakan @ Mohan Kumar. So far as these petitioners are concerned, no specific overt act has been attributed to them. The injury reports of the injured persons (Annexure-2 series) would show that while the informant Ram Kripal Singh, Sobhnath Kumar and Ramji Singh received simple injuries caused by hard and blunt substance, the injured Manoj Kumar has received a bullet injury in his right forearm which is also said to be simple in nature.
5. Learned APP for the State has opposed the application for anticipatory bail on account of the nature of allegations.
6. Taking into consideration the fact that these three petitioners have been generally named in the FIR whereas specific allegations are upon the other co-accused persons that

No.54913 of 2025(2) dt.22-08-2025 3/3 causing simple injuries, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand)each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bikramganj P.S. Case No. 78 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
