JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 498(A) and 34 of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.

The accusation is of torture for non-fulfillment of the dowry demand.

It is submitted by the learned counsel for the petitioners that the specific accusation is against the husband of the informant. The husband of the informant Shahid Iqubal filed Complaint Case No. 2669C of 2015 at earlier point of time against

Patna High Court Cr.Misc. No.6269 of 2016 (2) dt.08-02-2016 2/2 the informant and others. The husband of the informant has filed Matrimonial Case No. 391 of 2015 with a prayer for restitution of conjugal rites.

Considering the fact that specific accusation has been levelled against the husband of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Mainatand P.S. Case No. 106 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
