The petitioners are apprehending their arrest in connection with Dariyapur P.S. Case No. 138 of 2017, registered for the offence punishable under Section 366(A)/ 34 of the Indian Penal Code.
Allegation against the petitioners is of kidnapping the daughter of the informant.
Submission of learned counsel for the petitioners is that though the names of the petitioners are mentioned in the statement recorded under Section 164 Cr.P.C. of the victim but nothing specific allegation has been attributed to the petitioners. Further submission is that similarly situated co-accused, Nitesh
Patna High Court Cr.Misc. No.38830 of 2018 (2) dt.04-07-2018 2/2 Ram @ NJitesh Kumar has been granted privilege of regular bail by this Court vide order dated 8.9.2017 passed in Cr.Misc.No.39276 of 2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioners to surrender before the learned court below and pray for regular bail which will be considered by the learned court below on its own merit without being prejudiced by this order, if possible, on the same day.
