JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Barharia P.S. Case No. 279 of 2015 for the offences instituted under Sections 147, 148, 448, 341, 323, 380, 354, 504 and 506 of the IPC.
The prosecution story, in brief, is that on 21.08.2015 at 8.00 P.M. while the informant was sitting at her door then all
Patna High Court Cr.Misc. No.10963 of 2016 (2) dt.18-04-2016 2/3 accused persons came with Lathi, Danda and other weapons and assaulted the informant and her family members. Accused Sunil Ram assaulted Sahid Kaushar. Accused Parma Ram and Jitendra Ram assaulted Saiyada Khatoon. One of the accused assaulted the informant with Lathi in her stomach. Accused Prabhu Ram took the ornaments and clothes from the informant worth Rs. 1,00,000/- . It is further alleged that Sahid Kaushar, Sahzad Ali, Raies Alam, Saiyada Khatoon, Mister, Chanmunni Khatoon have sustained injury and their treatment is going to in the hospital. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The alleged occurrence is said to have taken place on 21.08.2015 but the F.I.R. was instituted on 23.08.2015. It is a case and counter case. From perusal of Annexure-2, it is evident that the uncle of the petitioner no. 1 was murdered by the informant side. The same has not been explained by the prosecution in Annexure-1.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Barharia P.S. Case
Patna High Court Cr.Misc. No.10963 of 2016 (2) dt.18-04-2016 3/3 No. 279/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
