Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 406, 420, 120B, 34 of the Indian Penal Code. The prosecution case is that the informant sold paddy worth Rs. 14,09,681/- between 15.01.2014 to 17.02.2014 to the petitioners but they paid only Rs. 8,95,236/- and promised to make payment of the balance amount of Rs. 5,14,445/- within one month but did not pay the consideration amount.
It is submitted by learned counsel for the petitioners that there is no proof with regard to the sale of the paddy made to the petitioners and even assuming the accusation, no offence under Sections, 406, 420 is made out against the petitioners.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Agiaon(Garhani) P.S. Case No. 124 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
