ANJANA MISHRA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/ 323/354 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that allegations against the petitioner are all bailable except under Section 354 of the Indian Penal Code which is concocted version. He further submits that there is a case between the mother of the petitioner as well as the informant's mother which has surfaced in paragraph No. 10 and 11 of the case dairy.

Learned counsel appearing on behalf of the State after

Patna High Court Cr.Misc. No.5343 of 2016 (3) dt.09-05-2016 perusal of the case diary submits that in fact such a statement has come in course of investigation.

Considering the aforementioned facts and circumstances and also that the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S. Case No. 359/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
