The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 472, 269, 270 of the Indian Penal Code. The prosecution case is that on 09.06.2015 the clinic of the petitioner was raided, when it was found a notice on the notice board that petitioner will not be available in the clinic from 18.06.2015 to 28.06.2015. It was found that Binod Pandey, Mokhtar Alam, Chandeshwar Baitha were illegally being treated in the clinic. It was further found that petitioner has no medical degree, nor he is registered Doctor.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.41880 of 2015 (2) dt.12-10-2015 petitioner that from the First Information Report it appears that the petitioner was not available in the clinic. The petitioner has got degree in Alternative Medicine from Kolkata and is registered Doctor of Alternative Medicine. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the suspicious nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Shri S.K. Shrivastava, Judicial Magistrate, Ist Class, Raxaul at Motihari, East Champaran in connection with Chhauradano P.S. Case No. 108 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
