The trial of the petitioner has already commenced but up till now informant has not been examined, therefore, considering the nature of allegation as well as submissions of the parties, I am not inclined to release the petitioner on bail, and hence, his prayer for bail in connection with Session trail no. 39 of 2016 arising out of Dhamdaha P.S.Case No. 169 of 2015, pending in the court of Vth Additional Sessions Judge, Purnea stands rejected.

However, the trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six month from the date of receipt/ production of a copy of this order, even by taking the trial of the petitioner on

Patna High Court Cr.Misc. No.29842 of 2017 (2) dt.05-07-2017 2/2 day to day basis because petitioner is in jail custody since 02.07.2015.
