JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for offences punishable under Section 302/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no overt act attributed to the petitioner except that he caught hold deceased. It has further been submitted that prior to the present case, the petitioner has lodged a case against the informant and others against the killing of younger brother of the petitioner and as such the petitioner has been falsely implicated in the present case.

Having heard both sides and in view of the fact that there
