This application is for grant of regular bail in connection with Mohiuddin Nagar P.S.Case No.139 of 2016 for the offences under Sections 147, 148, 149, 341, 323, 307 and 302 of the Indian Penal Code.

Allegation against the petitioner is of assault to the deceased.

Submission of the learned counsel for the petitioner is that there is no repetition of blow and it was also not by any dangerous weapon. It is submitted by the learned counsel for the petitioner that at best it is a case under Section 304 of the IPC. The petitioner is in custody for about one year.

Patna High Court Cr.Misc. No.19572 of 2017 (3) dt.05-07-2017 2/2 Heard learned A.P.P. as well as learned counsel for the informant. The learned counsel for the informant has opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
