JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2017 The petitioner seeks regular bail in connection with Lakhisarai P.S. Case No. 560 of 2016, registered for offences punishable under Section 39 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner's name has surfaced in this case only on the basis of confessional statement of co-accused and except that there is nothing against him. It has further been submitted that uptil now no Test Identification Parade has been conducted and he has been in judicial custody since 01.03.2017.

Learned counsel for the State opposed the prayer for bail and submitted that this is case of highway robbery. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to release the

Patna High Court Cr.Misc. No.26147 of 2017 (3) dt.05-07-2017 2/2 petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude it within a period of seven months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself.
