The petitioner apprehends his arrest in a case under Sections 341, 323, 324, 447, 308, 506/34 of the Indian Penal Code.

The informant alleged that while she was engaged in construction work of septic tank, Rishideo Rai and his son Mikki Kumar (the petitioner) came and assaulted her, her son and mason Suresh Rai. It is submitted that there is a case and counter-case, being Hajipur (Sadar) P.S. Case No. 592/2014. There is some dispute with regard to measurement of land. The petitioner objected to construction of septic tank on his land. The petitioner also got injuries. Suresh Rai (mason), the informant and her son got simple injuries, that too, caused by hard and blunt object. The injuries are simple in nature.

No.43895 of 2015 (3) dt.16-12-2015 2/2 Considering the facts aforesaid and the fact that there is a case and counter-case and the occurrence took place due to land dispute and simple injuries are found on the person of the injured, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in Hajipur Sadar P.S. Case No. 589/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
