JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with Tarari P.S. Case No. 81 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise At, 2016.

Police on information that accused persons are coming with liquor for sale, intercepted one motorcycle and three accused persons started fleeing away leaving the bag and one of them was arrested, who disclosed the name of the petitioner and other accused persons and from that 5 liters of Mahua liquor was recovered.

Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused, there is nothing against the petitioner, having no criminal antecedent. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Excise Act, Bhojpur, Ara, in connection with Tarari P.S. Case No. 81 of 2019 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
