This is an application for bail in connection with Sessions Trial No. 23 of 2017, arising out of Sasaram (T) P.S.Case No. 993 of 2016 registered for the offences punishable under Sections 304B and 120B/34 of the Indian Penal Code. Allegation is of dowry death and petitioner is husband of deceased.
It has been submitted on behalf of the petitioner that nothing specific has been attributed against the petitioner and the story of demand of motorcycle and chain does not appear to be probable, as according to FIR, demand was made after four years of marriage.
Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.34082 of 2017 (3) dt.22-08-2017 2/2 for bail stating that there is allegation of demand of dowry and cruelty and death was under abnormal circumstances. Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
However, it appears from the impugned order that the case has already been committed to the court of sessions, as such, learned trial court is directed to expedite the trial and try to conclude it as early as possible, preferably within a period of one year.
With the above observation, this application is dismissed.
