Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has filed the instant application for grant of regular bail in connection with Supaul Mahila P.S. Case No. 60 of 2020 registered under sections 341, 498(A), 494, 323, 504, 506 and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Allegation against the petitioner and his family members is that they used to torture and demand dowry of two lakh and one motorcycle, due to non fulfillment of the same, they tried to burn her after pouring kerosene oil. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No. 56064 of 2022(5) dt.14-03-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted that no prior complaint in respect of harassment, misbehave and demand of dowry. It is also submitted from para- 10 and 11 of this petition that the informant herself deserted the petitioner and did not want to live with him whereas the petitioner(husband) of the informant is ready to keep his wife with love and dignity. A statement has been made in para-3 of this petition that the petitioner is languishing in judicial custody since 06.12.2021. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Supaul (Mahila) P.S. Case No. 60 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
