Petitioners apprehend their arrest in connection with Darpa P.S.Case No. 25 of 2018 registered for the offences punishable under Sections 341, 324, 307, 379 and 34 of the Indian Penal Code.
Allegation as per FIR is that there was strained relationship between petitioner No.2 and her husband and for that she was living in her parents house and it is said that husband of petitioner No.2 was called in her parents house and there two unknown persons assaulted him by knife, causing injuries and it is alleged that petitioner No.2 engaged the accused persons for assault.
Patna High Court Cr.Misc. No.38873 of 2018 (2) dt.09-07-2018 2/2 Submission of learned counsel for the petitioners is that except suspicion there is nothing against the petitioners. Heard learned APP also, who has opposed the prayer for anticipatory bail stating that petitioners are conspirators. Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Raxaul, Motihari, East Champaran, in connection with Darpa P.S.Case No. 25 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
