The petitioner seeks bail in a case registered under Sections 363, 366(A), 372, 379, 120(B) of the Indian Penal Code and Sections 8, 12 of POCSO Act.
Allegation is that the accused persons including the petitioner kidnapped the daughter of the informant with intention to marriage or selling or killing.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.6.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has been recovered. Her statement under Section 164 of Cr.P.C. has been
Patna High Court CR. MISC. No.51710 of 2019(2) dt.20-08-2019 2/2 recorded. There is no allegation of physical or sexual assault alleged against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge 1st, Saharsa in connection with Salkhua P.S. case No.40 of 2019.
