The petitioners apprehend their arrest in Belaganj P.S. Case No. 157/2014, registered for the offences punishable under Section 323, 341, 354 and other sections of the Indian Penal Code and Section 3(I)(X)(XI) of S.C./S.T (Prevention of Atrocities) Act. The informant alleged that when she was irrigating her field, the petitioner along with other accused persons assaulted her with fists and slaps. When her Sister-in-law came to rescue, the petitioners also assaulted her.

It is submitted that the petitioners are owner of land and the informant tried to dispossess the petitioners from the aforesaid

Patna High Court Cr.Misc. No.40813 of 2015 (2) dt.06-10-2015 2/2 land. The petitioners filed a title suit no. 677/2014 in the Court of Civil Judge, Gaya for restraining prosecution side from interfering into the possession of petitioners. The informant herself stated in the F.I.R. that she got parwana of the land.

Considering the facts that occurrence took place on account of land dispute, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 157/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
